Maintained status does not mean 'everything stays the same': common worker misconceptions

“I’m on maintained status” has become a magic sentence in temporary-worker circles.

Said casually, it means: everything continues. Said accurately, it means something narrower: Immigration, Refugees and Citizenship Canada (IRCC) received a qualifying application before your status expired, and while you wait you may remain in Canada under conditions that depend on what you applied for.

The misconceptions below are the ones that create unpaid leave crises, border problems, and unauthorized work.

Misconception 1: Any pending IRCC application preserves work

No. Filing a visitor extension, a study permit, or an unrelated application is not the same as applying to continue working. The maintained-status benefit, when it exists, tracks the application type and prior conditions.

Misconception 2: Maintained status lets me switch jobs freely

If you held an employer-specific work permit, maintained status generally continues that reality — not an open-work free-for-all. Starting a new employer because “IRCC is slow” can breach conditions even while an application is pending.

Misconception 3: Travel is risk-free because I have a file number

Maintained status helps you stay. Re-entry depends on passport validity and a TRV or eTA where required, plus an officer’s assessment. People book holidays on maintained status and discover the return is the hard part.

Misconception 4: Provincial documents will renew as usual

As with students, being between permits can block renewals of things like certain licences or health coverage depending on the province. Plan renewals before expiry when you can — do not assume maintained status is a full administrative freeze-frame of normal life.

Your old permit document may still show the old expiry. Maintained status is a legal continuity concept while IRCC decides — not a reprinted plastic card. Employers and banks sometimes misunderstand this; keep submission proof handy, but do not invent rights the pending application does not support.

How to explain maintained status to an employer without overselling

HR teams often want a simple sentence. Give them an accurate one: you applied before expiry to continue authorization; you may continue under the conditions that apply while IRCC processes that application; you will share the decision when it arrives. Provide submission proof if appropriate. Do not promise an approval date you do not have.

If your pending application does not authorize continued work, say that early so staffing plans can adjust. Silence followed by a sudden stop-work is how trust breaks.

Bridging into PR applications

Some workers assume an Express Entry profile or a provincial expression of interest creates maintained status. It does not. Know which applications, if any, allow you to keep working after a work permit expires. When unsure, verify on IRCC pages or with a licensed representative before you rely on a portal screenshot as a work permit substitute.

SIN, banking, and everyday admin

Maintained status can confuse banks, landlords, and insurers who want to see a future-dated permit card. Carry submission proof, but do not invent rights. If an institution refuses service until a new permit arrives, that friction is sometimes real — plan cashflow and document renewals accordingly instead of assuming maintained status unlocks every counter service.

Open vs employer-specific continuity

Workers sometimes conflate open PGWP freedom with employer-specific maintained status. If your pending application and prior permit were employer-tied, continuity usually stays employer-tied. Read the conditions; do not import PGWP folklore into an LMIA-based file.
