Maintained Status for Workers

Overview

Maintained status (sometimes still called implied status in older conversations) is what workers rely on when an extension was filed on time and IRCC has not decided yet. Timing is everything: the receipt date must be before the expiry printed on your work permit.

Common situations

I applied weeks before expiry

If IRCC received your work permit extension before expiry, you may have maintained status and can usually keep working under your original conditions while you wait.

My permit expires this week and I have not filed

You do not have maintained status yet. File before expiry if you still can.

I applied to change employers, not just extend

My permit already expired

Did IRCC receive your application before expiry?

Compare two dates only:

1. Expiry date on your work permit
2. Date IRCC received your extension (confirmation / fee receipt in your account)

If (2) is before (1), maintained status may apply. If not, do not assume you can keep working.

What you can usually do on maintained status

According to IRCC guidance for timely work permit extensions:

• stay in Canada while the application is processed
• continue working under the conditions of your original work permit until a decision is made

You remain bound by those conditions (named employer, occupation, location, and other terms on the permit).

What maintained status does not fix

Practical limits often apply while on maintained status. You generally:

• cannot treat maintained status as a new work authorization for a different employer
• may face difficulty renewing certain provincial documents the same way
• cannot assume travel and re-entry will be straightforward

Renew important documents before your work permit expires when possible.

What this means in practice

• Keep a copy of your submission confirmation for your employer’s records.
• Continue only the work your original permit allowed.
• Do not start a new closed-permit job while waiting unless IRCC rules clearly authorize it.
• Plan re-entry documents before any trip outside Canada.

When to get help

Get advice if your receipt timing is unclear, your employer wants you to change roles or locations, you need to travel, or you may have filed after expiry.

Travel while an extension is pending

Maintained status protects your stay inside Canada. It does not automatically authorize re-entry after a trip. Before booking flights, read Travel While Permit Extension Is Processing and confirm you have a valid visa or eTA if required.

What is maintained status?

It is temporary continuity of your status as a temporary resident while IRCC processes an application you submitted before your authorization expired. For work permit extensions, you can usually keep working under original conditions.

Can I keep working on maintained status?

If IRCC received your work permit extension before expiry, you can usually continue working under the conditions of your original work permit until a decision is made.

Is maintained status automatic if I meant to apply?

No. What matters is whether IRCC received a complete application before expiry. A draft in the portal is not enough.

Can I leave Canada while on maintained status?

Travel is risky. Maintaining status inside Canada is not the same as being able to re-enter. You need the travel documents required to return, and leaving can end the practical benefit of waiting inside Canada.

How is this different from restoration?

Restoration applies when the permit expired before you applied. You lose worker status and cannot work until status is restored.

Can I change employers while on maintained status?

Usually you remain bound by your original conditions. Employer-specific permits typically do not authorize a new employer until a new permit (or specific authorization) is in place.
